By agreeing to participate in our services, you hereby agree to the following terms and conditions:

SERVICES

Coaching

Coaching is partnership (defined as an alliance, not a legal business partnership)

between the Coach and the Client in a thought-provoking and creative process that

inspires the client to maximize personal and professional potential. It is designed to

facilitate the creation/development of personal, professional or business goals and to

develop and carry out a strategy/plan for achieving those goals.

1.1. Coach-Client Relationship

A. Client is solely responsible for creating and implementing his/her own physical,

mental and emotional well-being, decisions, choices, actions and results arising out

of or resulting from the coaching relationship and his/her coaching calls and

interactions with the Coach. As such, the Client agrees that the Coach is not and will

not be liable or responsible for any actions or inaction, or for any direct or indirect

result of any services provided by the Coach. Client understands coaching is not

therapy and does not substitute for therapy if needed, and does not prevent, cure, or

treat any mental disorder or medical disease.

B. Client further acknowledges that he/she may terminate or discontinue the

coaching relationship at any time.

C. Client acknowledges that coaching is a comprehensive process that may involve

different areas of their life, including work, finances, health, relationships,

education and recreation. The Client agrees that deciding how to handle these

issues, incorporate coaching principles into those areas and implementing choices is

exclusively the Clientʼs responsibility.

D. Client acknowledges that coaching does not involve the diagnosis or treatment of

mental disorders as defined by the American Psychiatric Association and that

coaching is not to be used as a substitute for counseling, psychotherapy,

psychoanalysis, mental health care, substance abuse treatment, or other professional

advice by legal, medical or other qualified professionals and that it is the Clientʼs

exclusive responsibility to seek such independent professional guidance as needed. If

Client is currently under the care of a mental health professional, it is recommended

that the Client promptly inform the mental health care provider of the nature and

extent of the coaching relationship agreed upon by the Client and the Coach.

E. The Client understands that in order to enhance the coaching relationship, the

Client agrees to communicate honestly, be open to feedback and assistance and to

create the time and energy to participate fully in the program.

Mediation

Mediation is a guided process whereby the Participants voluntarily seek the support of a Mediator. The Mediator’s role is to hold space for Participants who are in conflict. Mediation is designed to facilitate communication between the Participants and provide a supportive and confidential environment for Participants to deepen understanding and move towards resolution.

2.1 Mediator - Participant Relationship

Mediation does NOT guarantee ANY particular outcome. Mediation is not prescriptive. Mediation is not directive.

By participating in a Mediation, the participant agrees that they fully consent to the Mediation process.

Participant understands that in order to best utilize the Mediation Process, the Participant must agree to communicate honestly, agree to Mediation Guidelines and to create the time and energy to participate fully in the process.

Consent can be withdrawn by any Participant at any time. Consent can be withdrawn by the Mediator at any time.

In the event that the Mediators or Participants have withdrawn consent, the Parties agree to pay for any services already rendered including prep work and intake.

3. Holistic Wellness Services

Holistic Wellness Services include Reiki and Breathwork. Reiki is an energy healing modality which utilizes light touch or no touch depending on the clients’ preferences. Reiki involves the client entering into a relaxed meditative state and allowing Practitioner to restore, balance, and clear the clients’ energy. Breathwork is a modality which utilizes light touch or no touch depending on the client’s preferences. Breathwork involves the Client agreeing to actively participate in a breath pattern guided by the Practitioner’s instructions and prompts.

3.1 Wellness Client-Practitioner Relationship

The Services described above in Section 3 are completely voluntary. By agreeing to these services, Client consents to receiving Practitioner’s guidance and expertise.

Neither Reiki nor Breathwork are recognized under the medical model and should not be used to diagnose or treat illness, disease, or any other medical conditions. However, these services may support Clients in the relief of symptoms that are connected to the emotional aspects of Client’s experience.

Reiki and Breathwork should not be used as a substitute for counseling, psychotherapy,

psychoanalysis, mental health care, substance abuse treatment, or other professional

advice by legal, medical or other qualified professionals and that it is the Clientʼs

exclusive responsibility to seek such independent professional guidance as needed.

4. Restorative Justice Support Services

Restorative Justice Support Services (“RJ”) may include 1) a guided process whereby the Participants voluntarily seek the support of a Conflict Resolution Practitioner (“Practitioner”) wherein one or more parties have been harmed. The Practitioner’s role is to hold space for Participants who are in conflict separately and where possible (all parties engagement is voluntary and consensual), together to investigate the source of harm, explore the impacts, and create findings and recommendations to support the parties going forward. 2) Where safety concerns are involved and parties are unable to meet for restorative dialogue, parties have the option to move forward separately in a coaching relationship if the practitioner consents. Parties may also have the option to move forward with holistic wellness services if desired and if the Practitioner consents.

RJ work is designed to facilitate communication between the Participants and provide a supportive and confidential environment for Participants to deepen understanding and move towards repair or resolution.

A. Client is solely responsible for creating and implementing his/her/their own physical,

of or resulting from the RJ process their

interactions with the Practitioner. As such, the Client agrees that the Practitioner is not and will

not be liable or responsible for any actions or inaction, or for any direct or indirect

result of any services provided by the Practitioner. Client understands RJ is not

therapy and does not substitute for therapy if needed, and does not prevent, cure, or

treat any mental disorder or medical disease.

B. Client further acknowledges that he/she may terminate or discontinue the

RJ processes at any time.

C. Client acknowledges that RJ is a comprehensive process that may involve

different areas of their life, including work, finances, health, relationships,

education and recreation. The Client agrees that deciding how to handle these

issues, incorporate coaching principles into those areas and implementing choices is

exclusively the Clientʼs responsibility.

D. Client acknowledges that RJ does not involve the diagnosis or treatment of

mental disorders as defined by the American Psychiatric Association and that

coaching is not to be used as a substitute for counseling, psychotherapy,

psychoanalysis, mental health care, substance abuse treatment, or other professional

advice by legal, medical or other qualified professionals and that it is the Clientʼs

exclusive responsibility to seek such independent professional guidance as needed. If

Client is currently under the care of a mental health professional, it is recommended

that the Client promptly inform the mental health care provider of the nature and

extent of the coaching relationship agreed upon by the Client and the Practitioner.

E. The Client understands that in order to engage in RJ process, the

Client agrees to communicate honestly, be open to feedback and assistance and to

create the time and energy to participate fully in the program.

F. The Client understands and agrees that due to the collaborative nature of the RJ process, the Practitioner reserves the right to inform the parties of one another’s engagement, ability, or willingness to participate in the process because each party’s involvement in the process has impacts on the other parties.

G. Restorative Justice Guidelines

Restorative Justice Services does NOT guarantee ANY particular outcome.

Restorative Justice is not prescriptive.

Restorative Justice is not punitive.

By participating in a Restorative Justice Services, the participant agrees that they fully consent to Restorative Justice process which will be outlined on a case by case basis by the Practitioner in the Letter of Engagement which outlines in detail the scope of services to be provided, the costs, and any additional requirements specific to the scope of work.

H. Participant understands that in order to best utilize the Restorative Justice Process, the Participant must agree to communicate openly and honestly, agree to Restorative Justice Guidelines and to create the time and energy to participate fully in the process.

Consent can be withdrawn by any Participant at any time. Consent can be withdrawn by the Practitioner at any time.

I. In the event that the Practitioners or Participants have withdrawn consent, the Parties agree to pay for any services already rendered including prep work and intake.

POLICY FOR SERVICES

5. Confidentiality

As part of a practitioner and client relationship, information (documented or verbal) that the Client shares while receiving services listed in sections 1 - 4 is bound by the principles of

confidentiality. However, please be aware that the Practitioner-Client relationship is not

considered a legally confidential relationship (like the medical and legal professions)

and thus communications are not subject to the protection of any legally recognized

privilege. The Coach agrees not to disclose any information pertaining to the Client

without the Clientʼs written consent. The Coach will not disclose the Clientʼs name as

a reference without the Clientʼs consent.

Confidential Information does not include information that: (a) was in the Practitioner’s

possession prior to its being furnished by the Client; (b) is generally known to the

public or in the Clientʼs industry; (c) is obtained by the Practitioner from a third party,

without breach of any obligation to the Client; (d) is independently developed by the

Practitioner without use of or reference to the Clientʼs confidential information; or (e) the

Practitioner is required by statute, lawfully issued subpoena, or by court order to disclose;

(f) is disclosed to the Practitioner and as a result of such disclosure the Practitioner reasonably

believes there to be an imminent or likely risk of danger or harm to the Client or

others; and (g) involves illegal activity. The Client also acknowledges his or her

continuing obligation to raise any confidentiality questions or concerns with the

Practitioner in a timely manner.

*Please note that in collaborative multi-party cases such as Mediation or RJ, some disclosure of client’s participation may be required in order to facilitate the delivery of services. Disclosures will contain the minimum necessary information to facilitate participation, and support parties in determining how to move forward with their cases.

6. Procedure

The time of the Service and/or location will be determined by Moksha and

Client based on a mutually agreed upon time. The Client will initiate the service by filling out the Intake Form located at https://www.mokshacollab.com/get-started

7. Late Cancellation Fee

Moksha Healing Collaborative upholds a 24 hour cancellation policy.

The charge for a Late Cancellation is the full session rate of the Service that was selected.

7.1 The “Cancellation Deadline” means, with respect to any scheduled appointment, 24

hours prior to the originally scheduled time of such appointment.

7.2 “Late Cancellation” means any cancellation or rescheduling of an appointment after

the Cancellation Deadline other than any cancellation or rescheduling thereof that

constitutes a "No Show"(as defined below).

7.3 The charge for a Late Cancellation is 80% of the agreed upon Service Fee for the session.

Your clinician/coach reserves the right to waive the late cancellation fee (per their

discretion) if you reschedule the appointment within the same week.

8. No Show Policy

8.1 “No Show” is when a client fails to attend an appointment without canceling or

rescheduling such an appointment.

8.2 For 60 minute appointments, you are considered "no show" if you do not arrive/sign

in within 15 minutes late for your appointment.

8.3 For 30 minute appointments, you are considered "no show" if you do not arrive/sign

in within 7 minutes late for your appointment.

8.4 Please email your practitioner if you are running late for your appointment.

8.5 The charge for a No Show is 100% of the agreed upon Service Fee for the session.

Your clinician/coach reserves the right to waive the no show fee (per their

discretion) if you reschedule the appointment within the same week.

TERMS AND CONDITIONS

9. Limited Liability

Except as expressly provided in this Agreement, the Practitioner makes no guarantees,

representations or warranties of any kind or nature, express or implied with respect

to the coaching services negotiated, agreed upon and rendered. In no event shall the

Practitioner be liable to the Client for any indirect, consequential or special damages.

Notwithstanding any damages that the Client may incur, the Practitioner’s entire liability

under this Agreement, and the Clientʼs exclusive remedy, shall be limited to the

amount actually paid by the Client to the Practitioner under this Agreement for all coaching

services rendered through and including the termination date.

10. Entire Agreement

This document reflects the entire agreement between the Practitioner and the Client, and

reflects a complete understanding of the parties with respect to the subject matter.

This Agreement supersedes all prior written and oral representations. The Agreement

may not be amended, altered or supplemented except in writing signed by both the

Coach and the Client.

11. Dispute Resolution

If a dispute arises out of this Agreement that cannot be resolved by mutual consent,

the Client and Coach agree to attempt to mediate in good faith for up to (certain

amount of time such as 30 days) after notice given. If the dispute is not so resolved,

and in the event of legal action, the prevailing party shall be entitled to recover

attorneyʼs fees and court costs from the other party.

12. Severability

If any provision of this Agreement shall be held to be invalid or unenforceable for any

reason, the remaining provisions shall continue to be valid and enforceable. If the

Court finds that any provision of this Agreement is invalid or unenforceable, but that

by limiting such provision it would become valid and enforceable, then such provision

shall be deemed to be written, construed, and enforced as so limited.

13. Waiver

The failure of either party to enforce any provision of this Agreement shall not be

construed as a waiver or limitation of that party's right to subsequently enforce and

compel strict compliance with every provision of this Agreement.

14. Applicable Law

This Agreement shall be governed and construed in accordance with the laws of the

State of California, without giving effect to any conflicts of laws provisions.

Breathwork for Liberation

Breathwork is a powerful somatic tool that allows for deep processing and integration. As you breathe, your body enters the parasympathetic state which slows down our breathing, heart rate, and blood pressure, enabling our body to enter a state of relaxation and recovery.

Breathwork carries us out of the "fight or flight" response and gives us a chance to heal, process, and re-regulate.

Join us on September 22nd from 5-6:30 p.m. for guided breathwork. Our session will be devoted to embodying liberation. This experience will also include time for journaling and shared reflection.
